Your Oasis Counseling ("Practice," "we," "us," or "our") is committed to protecting the privacy, confidentiality, and security of client information. This Privacy Policy is written in accordance with the rules and ethical standards of the Texas Behavioral Health Executive Council (BHEC), the Texas Administrative Code, and applicable federal laws, including the Health Insurance Portability and Accountability Act (HIPAA), when applicable.

1. Applicability and Provider Status

Counseling services at Your Oasis Counseling are provided by a Licensed Professional Counselor Associate (LPC-Associate) operating under the supervision of a Texas-licensed Licensed Professional Counselor Supervisor (LPC-S), as required by BHEC rules.

Client information may be reviewed or discussed during clinical supervision for training, compliance, and quality-of-care purposes. All supervisory disclosures are conducted in a confidential and professional manner consistent with Texas law.

2. Information Collected

Your Oasis Counseling may collect the following information:

A. Identifying and Contact Information

  • Name, date of birth, address, phone number, and email address
  • Emergency contact information


B. Clinical and Health Information

  • Intake forms, assessments, and clinical documentation
  • Session notes and treatment-related information
  • Diagnoses, treatment plans, and progress notes


C. Financial and Administrative Information

  • Payment records and billing information
  • Insurance information, if applicable


D. Electronic and Website Information

  • Information submitted through website contact forms
  • Email, text, or voicemail communications


Website forms are not intended for emergency communication.

3. Use of Information

Information is used solely for purposes consistent with counseling services, including:

  • Providing mental health services
  • Scheduling and administrative communication
  • Billing and recordkeeping
  • Legal, ethical, and regulatory compliance under BHEC


Client information is never sold or used for marketing purposes.

4. Confidentiality and Permitted Disclosures

All client information is confidential under Texas law.

Disclosure without written authorization may occur only as permitted or required by law, including:

  • Risk of serious harm to the client or others
  • Suspected abuse or neglect of a child, elderly person, or dependent adult
  • Court orders, subpoenas, or legal mandates
  • Clinical supervision under BHEC requirements


Only the minimum necessary information is disclosed when required.

5. Electronic Records, Communication, and Telehealth

Your Oasis Counseling uses reasonable safeguards to protect electronic records.

  • Email and text communication are primarily used for scheduling and administrative purposes
  • Therapeutic services are not provided via email or text
  • Electronic communication carries inherent risks despite safeguards


Telehealth services are provided through secure, HIPAA-compliant platforms. Clients acknowledge potential risks including technical failures or unauthorized access.

The clinician may determine that telehealth is no longer clinically appropriate and recommend alternative services.

6. Record Storage and Retention

Client records are maintained securely and retained in accordance with Texas record retention requirements established by BHEC and applicable laws.

Access to records is limited to authorized individuals only.

7. Client Rights Under Texas Law

Clients have the right to:

  • Request access to their records
  • Request amendments to records
  • Receive information about disclosures when applicable
  • File a complaint with the Texas Behavioral Health Executive Council


Requests must be submitted in writing and may be subject to legal limitations.

8. Pro Bono, Reduced-Fee, and Promotional Services

Privacy and confidentiality protections apply equally to all clients, including those receiving:

  • Pro bono (no-cost) services
  • Sliding-scale or reduced-fee services
  • Discounts or promotional offerings

Financial arrangements do not affect privacy rights.

9. Policy Updates

This Privacy Policy may be updated to reflect changes in BHEC rules, Texas law, or Practice operations. Updates will be effective upon posting with a revised effective date.
